MEMORANDUM IN SUPPORT

A BUDGET BILL submitted by the Governor
in accordance with Article VII of the Constitution

AN ACT to amend chapter 60 of the laws of 2006, in relation to providing for the administration of certain funds and accounts related to the 2006-2007 budget; in relation to authorizing certain payments and transfers

Purpose: This bill is intended to facilitate implementation of the 2006-07 State budget by amending Chapter 60 of the Laws of 2006 to transfer an additional $6 million in General Fund Public Transportation Operating Assistance for Upstate Transit.

Section 1 of this bill would increase the General Fund transfer to the Public Transportation Operating Assistance (PTOA) account by $6 million to support both the Mass Transportation Operating program (under section 18-b of the Transportation Law, which requires local matching payments for State transit aid) and the Mass Transportation Operating Assistance Fund Program (no local match required) in the Department of Transportation Aid to Localities Budget.

Section 2 provides that the bill shall take effect immediately and be deemed to have been in full force and effect on and after April 1, 2006.

Existing Law: This is a new bill.

Statement in Support: Enactment of this bill is necessary to provide funding for liabilities occurring in the 2006-07 fiscal year that exceed the budgeted resources, and to otherwise facilitate complete implementation of the 2006-07 budget.

Budget Implications: The provisions of this bill are accommodated in the current Financial Plan for 2006-07.
